This document (General Conditions of Sale) defines the conditions applicable to sales concluded between, on the one hand, persons wishing to make a purchase via the Cosmeticary website https://www.cosmeticary.com, hereinafter referred to as "the customer" and, on the other hand, the company Cosmeticary whose registered office is located at Rue A. Orts 11B. 1000 Brussels, whose intra-community VAT number is BE0871818578 , hereinafter referred to as "cosmeticary.com". These conditions only concern non-commercial individuals.

PRICE

All product prices are listed in euros, inclusive of all taxes, excluding shipping costs (see Shipping and Delivery section). Cosmeticary.com reserves the right to change its prices at any time without prior notice. Products will be invoiced based on the rates in effect at the time orders are placed. Products remain the property of Cosmeticary.com until full payment has been received by Cosmeticary.com. The price is payable in full and in a single payment.

ORDERS

The customer can order online via the website www.Cosmeticary.com. Cosmeticary.com reserves the right to cancel or refuse any order from a customer with whom there is a dispute regarding the payment of a previous order or who, in its view, presents any form of risk. Any order implies acceptance of the prices and description of the products available for sale. Cosmeticary.com undertakes to honor orders received on the website only within the limits of available stocks of the products. If one or more ordered products are unavailable, Cosmeticary.com undertakes to inform the customer as soon as possible. The customer's order will then be automatically canceled and the corresponding amount refunded.

SHIPPING AND DELIVERIES

Delivery by BPost

Delivery costs:

  • For Belgium: €5.25 (free for purchases of €60 or more)
  • For the Netherlands and Luxembourg: €6.95
  • For Germany and mainland France: €7.95
  • For the rest of Europe (excluding French overseas departments and territories): €14.95

Our shipping times are as follows:

  • For any order placed Monday to Friday before 1 p.m., the order will be shipped the same day.
  • For any order placed Monday to Thursday after 1 p.m., the order will be shipped the next day.
  • For any order placed from Friday after 1 p.m. to Sunday evening, the order will be shipped the following Monday.
  • For any order placed on public holidays, the order will be shipped the following business day.

Delivery times are 48 working hours (excluding weekends and public holidays) for Belgium and can be up to 30 days for the rest of Europe.

No home deliveries are made on Saturdays, Sundays or public holidays.

Cosmeticary.com makes every effort to fulfill orders within the timeframes listed above, but delays may occur due to unforeseen circumstances or the delivery area. 

If Cosmeticary.com is unable to meet delivery times for any reason, it will inform the customer and offer to either continue the purchase process with a new delivery date or cancel the order and refund the full amount paid.

PAYMENT

Payment is made by credit card or bank transfer.

RIGHT OF WITHDRAWAL

By law, the customer has the right to withdraw from a contract concluded online or by telephone without giving any reason within 14 days of delivery of the goods. At Cosmeticary.com, every buyer has the right to withdraw from the contract without giving any reason within 30 days of delivery of the goods. This also applies to purchases made in our physical store.

If the customer wishes to exercise this right, it is advisable to inform Cosmeticary.com of their decision to withdraw from the agreement within the aforementioned period. The best way to do this is to contact us via office@cosmeticary.com or by calling +32 (2) 346 89 62. The customer can also use the withdrawal form ( Download the withdrawal form )

In the event of termination of the contract, Cosmeticary.com will refund the customer the purchase price of the goods. In the event of termination within 14 days of delivery of the goods, the customer will also be entitled to a refund of the delivery costs in an amount corresponding to the least expensive delivery method offered. In the event of subsequent termination of the contract, Cosmeticary.com will only refund the purchase price of the goods. The aforementioned funds will be refunded without delay, and no later than 14 days after the date of termination. However, in accordance with the law, Cosmeticary.com may defer the refund until the goods have been returned to us, or until the consumer has provided proof of shipment of the goods, whichever comes first. For the refund, Cosmeticary.com will use the same means of payment that the customer used to pay the purchase price.

The customer must return the goods without delay, and at the latest within 14 days from the date of withdrawal, to the address Rue Auguste Orts 11B - 1000 Brussels (Belgium). If, as part of the conclusion of the contract, additional goods ("gift") were sent to the customer free of charge by the seller, it is necessary to return said gift with the goods to be returned. The customer will provide the customer with all necessary information regarding the shipment of the goods via the contacts mentioned.

It should be noted that, in accordance with the law, the customer will be held liable for any reduction in the value of the goods resulting from handling the goods in a manner other than that necessary to familiarize himself with the nature, properties and functionality of the goods (for example: if the customer continues to use a perfume even after having already tried it). It should also be noted that the customer is not entitled to withdraw from the contract in the case of products made to his specifications or personalized products and sealed products that cannot be returned for reasons of health protection or hygiene and which have been unsealed by the consumer after delivery. 

In the event of withdrawal from the contract, Cosmeticary.com will refund all payments received from the customer, including, where applicable, delivery costs. For the refund, Cosmeticary.com will use the same means of payment that the customer used to pay the purchase price.

SECURING TRANSACTIONS

Cosmeticary.com implements all means to ensure the confidentiality and security of data transmitted on the web and on the website https://www.cosmeticary.com. As such, the website uses a secure payment module type SSL (Secure Socket Layer).

INTELLECTUAL PROPERTY

All texts, comments, works, illustrations and images reproduced on Cosmeticary.com are reserved under copyright and intellectual property law worldwide. As such, and in accordance with the provisions of the Intellectual Property Code, only use for private purposes is authorized, subject to different or even more restrictive provisions of the Intellectual Property Code. Any total or partial reproduction of the Cosmeticary.com site is strictly prohibited without prior agreement.

RESPONSIBILITY

Cosmeticary.com has, for all stages of access to the site, the ordering process, delivery, customer service or subsequent services, only an obligation of means. Cosmeticary.com cannot be held liable for any inconvenience or damage inherent to the use of the internet network, in particular a breakdown in service, an external intrusion or the presence of computer viruses, or any event qualified as force majeure, in accordance with case law.

LEGAL GUARANTEE OF CONFORMITY OF GOODS

The legal guarantee corresponds to the guarantee on consumer goods provided for by articles 1649bis et seq. of the Civil Code, also known as the "guarantee of conformity," which protects the customer when the products purchased by a customer contain a lack of conformity. The legal guarantee of conformity benefits all individuals residing in the European Union.

If the customer encounters a problem with a product sold, the customer can contact our customer service.
The 2-year legal guarantee applies to any lack of conformity of the product that the customer has purchased, i.e. when in particular :
- The characteristics of the purchase do not correspond to those of the model presented;
- The quality and services do not meet the expectations that the customer had; or
- The customer cannot use the product for its intended use or for the specific functions requested.

Rights provided for by the legal guarantee of conformity:
If the product purchased by the customer has a defect covered by the guarantee of conformity, the customer has the right to obtain, free of charge, a repair or replacement of the product. The customer has the right to obtain a price reduction or termination of the contract in the following cases:
- If repair or replacement of the product is not possible;
- If the replacement or repair cannot be implemented within a reasonable time;
- If the replacement or repair cannot be implemented without major inconvenience to the customer.
Please note that a minor defect for which repair or replacement is not possible or excessively expensive does not give rise to termination of the contract.

Duration of the legal guarantee of conformity:
The legal guarantee of conformity covers defects of conformity that occur within two years of delivery of the product purchased by the customer. The customer is advised to retain proof of purchase of the product. Defects of conformity that appear within two years of delivery of the product are presumed to exist at the time of delivery, except when this presumption is not compatible with the nature of the product or the nature of the defect of conformity or unless proven otherwise.

Exchange, return and refund

If the goods are defective upon delivery, the customer is entitled to have the goods repaired or replaced, or to a price reduction or termination of the contract with a refund - with the customer's consent, these damages may also take the form of a voucher. The customer is also entitled to demand the elimination of the defect in the form of a replacement delivery or repair. If the elimination of a defect is impossible or unreasonable for us, the customer is entitled to claim a discount on the purchase price and, if the defect is substantial, may also terminate the purchase contract. The customer also has these rights if such a defect becomes apparent later. If a product is missing from the order, it is necessary to notify Cosmeticary.com so that we can deliver the product at our expense. If delivery of the product within a further and reasonable time is not possible, Cosmeticary.com will reimburse the customer for the costs according to the option selected in the complaint form.

Cosmeticary.com will be liable for defects in the goods if these become apparent within two years of delivery of the goods.

Goods are considered defective, in particular when they do not possess the usual or presented properties, do not serve their purpose, do not comply with legal requirements, or have not been delivered in the agreed quantities. Please note that increased sensitivity or an allergic reaction to the delivered products cannot in itself be considered a defect in the products. Likewise, defects in gifts and other free services that Cosmeticary.com provides beyond the scope of the order do not constitute a defect. The images of the products in our online shop are for illustrative purposes only and do not constitute a binding representation of their properties (e.g., the packaging may differ due to a change made by the manufacturer).

Cosmeticary.com will be happy to answer any questions regarding complaints at office@cosmeticary.com or +32 2 346 89 62. Please return the complained goods to Rue Auguste Orts 11B - 1000 Brussels (Belgium). The customer is advised to indicate what they believe to be a defect or how the defect manifests itself, as well as their requirements for the handling of their complaint.

Cosmeticary.com will inform the customer of the progress of the complaint, including its receipt, acceptance, or rejection, by email. Cosmeticary.com may also contact the customer by telephone.

Cosmeticary.com will decide on the complaint without delay. Complaint processing, including defect rectification, will normally not exceed 30 days. Otherwise, the customer has the right to withdraw from the purchase contract. The customer must provide Cosmeticary.com with the necessary assistance to meet the above deadline.

In the event of a justified complaint, Cosmeticary.com will bear the costs associated with returning the goods.

PROTECTION OF PERSONAL DATA

Cosmeticary.com reserves the right to collect customer data, including through the use of cookies, in accordance with current legislation. The user may expressly object to the disclosure of their contact information. To do so, simply notify Cosmeticary, Customer Service, Rue A. Orts 11B, 1000 Brussels. In accordance with the law of 6 January 1978, the user has the right to access and rectify their personal data. Cosmeticary.com uses cookies to recognize the customer when they log in to the website www.cosmeticary.com. The customer may deactivate the use of these cookies at any time by selecting the appropriate settings in their browser.

REVIEW MANAGEMENT POLICY

Judge.me automatically verifies reviews based on Cosmeticary.com 's order history. If the reviews are not associated with existing orders (e.g., coming directly from Cosmeticary.com websites), Cosmeticary.com may request manual verification by submitting proof of orders.

A verified buyer badge is added once the review has been verified by Judge.me. The badge can be translated and customized, but cannot be added by Cosmeticary.com itself.

Ask for an opinion

Cosmeticary.com sends a review request via email to customers based on settings and conditions. Automatic reminders or web push notifications can be enabled. Cosmeticary.com can also request a review from past customers, not send an automatic review request, or request/remind individual users. Cosmeticary.com may respond privately or publicly to any review.

Give an opinion

The customer can leave a review in the email review form or via the review widget. Product reviews are submitted via the review widget, while store reviews are submitted via the All Reviews page. Visitors can leave reviews without a (traceable) purchase history ("web reviews"). These can be disabled but will never receive a "Verified Buyer" badge if the reviewer's email is not part of the store's customer list. Reviews provided by the same email will have the same display name.

Reviews are always voluntary. Cosmeticary.com does not pay their authors to write them.

The email address the customer provides will not be published and is only used for verification purposes.

Change the policy

Reviews may be edited to address typos, style/formatting issues, or minor review information. However, star ratings cannot be changed to maintain the integrity of reviews on Judge.me. After an edit, a notification email is sent to the reviewer informing them of any changes. The reviewer can reject any edit by clicking within the notification email. The Judge.me team is notified of all review edits and review rejections.

Star Calculation Method

For the overall product rating, all reviews given are taken into account to create an average.

Review of curation

Cosmeticary.com has complete control over posting and hiding reviews, and new reviews are automatically published by default. Merchants can enable review curation to manually choose which reviews to publish.

Cosmeticary.com makes every effort to ensure that review content is useful and honest. Reviews may be removed if they do not comply with our review policy.

Contributions must be based on real experiences and information. Intentionally false content, irrelevant content, defamatory language, personal attacks, and unnecessary or incorrect content are all against our policy.

Cosmeticary.com reserves the right to disable customer contributions to prevent abuse. Cosmeticary.com also reserves the right to remove content that violates our policies.

The content that Cosmeticary.com monitors and disables when detected is as follows:

Dangerous or denigrating content

  • Content that is threatening or incites self-harm, or threatens or incites harm to others.
  • Content that harasses, intimidates, or offends an individual or group.
  • Content that incites hatred or discrimination against an individual or group, or denigrates an individual or group based on race or ethnic origin, religion, disability, age, national origin, veteran status, sexual orientation, gender, gender identity, or any other characteristic associated with systematic discrimination or marginalization.

Spam or incorrect content

  • The same content posted multiple times.
  • Content for the same product from multiple accounts by the same reviewer.

Irrelevant content

  • Content that is not based on the reviewer's experience purchasing a good or service from the company where the review is posted.
  • Content containing political or social commentary or personal diatribes.

Advertisement

Content that contains calls to action or offers to sell products or services.

Offensive content

Containing obscene, defamatory or offensive language or gestures.

Sexually explicit content

Content containing sexually explicit material.

Identity theft

Content attributed to individuals, organizations, or companies that the author is not authorized to represent.

Conflict of interest

Content that is not fair or impartial, such as:

  • A review written about the author's own business.
  • A review of current or past professional experience.
  • A dishonest review intended to influence a competitor's evaluation.

Illegal content

Illegal content or content depicting illegal activities.

Report a potentially fake review

Customers can report a potentially fake review by sending an email to office@cosmeticary.com. Cosmeticary.com will then investigate whether the reported review is indeed fake and whether it should be removed. The author of any reported or suspected review will be systematically contacted by email to justify their review and possibly provide proof of purchase. Any reported or suspected review not justified within 72 hours will be systematically deleted.
